Energy Citation Programs
Resource Adequacy Requirement Citation Program
On October 5, 2006, the Commission enacted Resolution E-4017 adopting a Resource Adequacy Requirement (RAR) Citation Program, delegating the authority to issue citations and levy fines for specific violations to Energy Division in order to enforce all Load Serving Entities’ (LSE) compliance with system and local resource adequacy. Resolution E-4017 was superseded and replaced in its entirety by Resolution E-4195 on November 6, 2008. At that time the authority to issue citations and levy fines was transferred to the Utilities Enforcement Branch (UEB). UEB also undertakes formal investigations of allegations of non compliance with resource adequacy requirements where such violations fall outside the Citation Program.
Renewables Portfolio Standard Citation Program
On October 29, 2009, the Commission enacted a citation program for noncompliance with mandatory filing deadlines and reporting requirements of the Renewables Portfolio Standard (RPS) in Resolution E-4257. The Consumer Protection and Enforcement Division (CPED) issues citations and levies fines for specific violations to enforce compliance with RPS reporting requirements.
California Environmental Quality Act Citation Program
Resolution E-4550, adopted May 9, 2013, created the California Environmental Quality Act (CEQA) Citation Program authorizing Commission Staff to fine public utilities for non-compliance with Permits to Construct (PTC) and Certificates of Public Convenience and Necessity (CPCN) issued for natural gas storage facilities, electric generating plants, electric transmission/power/distribution line facilities, and substations. Energy Division (ED) refers cases to UEB when it finds a CEQA violation and recommends enforcement action.
Core Transport Agent Citation Program
On October 25, 2018, the Commission enacted Resolution UEB-003 adopting a Core Transport Agent (CTA) Citation Program, delegating the authority to CPED to issue citations of $1,000 per incident to CTAs that fail to comply with the standards for verification of change in provider requirements in D.18-02-002.
Integrated Resource Plan Citation Program
On August 7, 2020, the Commission enacted Resolution E-5080 adopting an Integrated Resource Plan (IRP) Citation Program, delegating the authority to commission staff to cite load serving entities (LSEs) for non-compliance with mandatory filing deadlines and reporting requirements of the IRP proceeding.
Disconnections Citation Program
On December 17, 2020, the Commission enacted Resolution UEB-006 adopting a Disconnections Citation Program, delegating the authority to commission staff to enforce compliance with the disconnections-related consumer protection rules authorized by D.20-06-003.
