CD Citation Program for Service Providers
On June 21, 2018, the Commission adopted Resolution T-17601 that authorized Communications Division to implement a citation program for enforcing compliance by telecommunications carriers with the Commission’s Resolutions, Decisions, Orders and the Public Utilities Code. Appendix A of the Resolution included a table of Specified Violations and Maximum Penalty Schedule.
Communication Division staff will issue a citation to a service provider when a violation is identified. Within 30 days after the citation date the service provider must either: (1) correct the violation and remit the full amount of the penalty with notice to Staff; or (2) file and serve a Notice of Appeal, pursuant to ALJ-377 (Resolution ALJ-377 Appendix A and Resolution ALJ-377 Appendix B).

Special Instructions for carriers issued a citation related to Surcharges and User Fees:
Carriers issued a citation related to surcharges and user fee must provide copies of their correspondence including CD citation payment form and CD Citation Appeal to telcosurcharge@cpuc.ca.gov. The forms below have been updated to include the additional email address:

Failure to comply with the citation notice (i.e., failure to file the required report(s) and payment of the increased penalty amount) may result in a revocation of the company’s operating authority. Entities that continue to operate and failed to comply with the P.U. Code while operating in California are subject to enforcement action by the CPUC including possible fines or other sanctions. Pursuant to CPUC Resolution T-17601, the CPUC has the authority to assess fines of $1,000 for every month a carrier has been operating without authority in California, and the full Commission may consider much larger fines, penalties, or other sanctions pursuant to P.U. Code sections 2107 and 2108.
